Description

Key Accountabilities and Result Areas:

>Implementing the Statutory Tribunal processes for SEND and working with pupils, families, schools, and other stakeholders to assist in processes linked to securing appropriate resolution for pupils within the SEN Tribunal Process

>Reviewing the type of appeal, assessing the skills and knowledge required to address the issues in dispute in the appeal, to conduct an assessment of the potential risks to the LA, both financial and reputational, associated with any appeal and briefing the SEND Tribunals Manager and Head of SEND as appropriate.

>Taking direct responsibility for a range of Tribunal appeals, ranging from refusal to assess appeals to complex cases dealing with school placements with high-cost implications. This will include leading on the carrying out of Tribunal casework, ensuring that all casework is conducted in a timely and efficient manner and in line with Tribunal set deadlines.

>Leading on the LA's response to a number of Tribunal appeals including extended appeals. Including detailed and close liaison with colleagues and management in social care and the ICB, including relevant practitioners and commissioners. To present the LA's position in such matters to the Tribunal as a whole following that work with social care and the ICB.

Essential knowledge:

Knowledge of SEND Legislation and willingness to attend further training in special educational needs and related social care legislation as appropriate ( Families Act/Care Act; SEND Reforms) - short course/day training
Working knowledge and understanding of SEND legislation and willingness to expand that knowledge (Families Act 2014; SEND Code of Practice January 2015).Knowledge and understanding of government policy and initiatives - and their implication for the role

Experience:

Proven experience of working in a Local Authority/public or third sector, or legal role with accountability for working with the public and/or schools/education settings.
Legal experience or an equivalent legal qualification/relevant qualification or substantial experience in SEND.
Experience of managing a range of administrative functions and systems in a multi-disciplinary environment.
MUST HAVE experience in Drafting responses and draft submisisons to tribunals comms with parents and pros
Tribunal experience confident and experience in attending hearings
